VOLUNTEER RELEASE AND WAIVER OF LIABILITY:

By volunteering with Heart of Dinner Inc., a New York nonprofit corporation, and engaging in activities to assist with its mission, you acknowledge that:

  1. the Activities may include, but are not limited to, packaging, walking, carrying and delivering meals and groceries approximately 50 pounds or heavier depending on the items, decorating bags, writing notes;

  2. as a volunteer you will receive no compensation for your services and will not be eligible for any employee benefits;

  3. you are not an employee;

  4. you have read and agree to the Heart of Dinner Volunteer Code of Conduct, which is part of this agreement.

By participating in the Activities as a volunteer, you agree to the following terms:

  1. Assumption of Risk. You are aware and understand that the Activities may be inherently dangerous and may expose you to a variety of foreseen and unforeseen hazards and risks. You are voluntarily participating in the Activities and have considered those risks. You expressly and specifically assume those risks, including any and all risk of injury, harm, or loss that you may incur.

  2. Medical Treatment. You give consent and authority to Heart of Dinner to obtain medical treatment on your behalf if you are injured or require medical attention during your participation in the Activities. You understand and agree that you are solely responsible for all costs related to such medical treatment, medical transportation, and/or evacuation. You hereby release, forever discharge, and hold harmless the Organization from any claim whatsoever in connection with such treatment or other medical services.

  3. Release and Waiver. You fully and forever release and discharge Heart of Dinner from, and expressly waive, any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, that may arise from your participation in the Activities. You agree not to make or bring any such claim or demand against the Organization, and fully and forever release and discharge the Organization from liability under such claims or demands.

YOU UNDERSTAND THAT THIS RELEASE DISCHARGES THE ORGANIZATION FROM ANY LIABILITY OR CLAIM THAT YOU MAY HAVE AGAINST THE ORGANIZATION WITH RESPECT TO ANY BODILY INJURY, PERSONAL INJURY, ILLNESS, DEATH, PROPERTY DAMAGE, OR PROPERTY LOSS THAT MAY RESULT FROM THE ACTIVITIES, WHETHER CAUSED BY THE NEGLIGENCE OF THE ORGANIZATION OR OTHERWISE TO THE EXTENT ALLOWED BY LAW. YOU WARRANT AND REPRESENT THAT YOU ARE OF SOUND MIND AND NOT ACTING UNDER DURESS OR UNDUE INFLUENCE, AND YOU HAVE READ AND UNDERSTOOD THIS AGREEMENT PRIOR TO PARTICIPATING IN THE ACTIVITIES.

 

4. Insurance. YOU UNDERSTAND THAT, EXCEPT AS AGREED TO BY HEART OF DINNER IN WRITING, HEART OF DINNER DOES NOT ASSUME ANY RESPONSIBILITY FOR OR OBLIGATION TO PROVIDE FINANCIAL ASSISTANCE OR OTHER ASSISTANCE, INCLUDING BUT NOT LIMITED TO MEDICAL, HEALTH, OR DISABILITY INSURANCE OF ANY NATURE IN THE EVENT OF YOUR INJURY, ILLNESS, OR DEATH, OR DAMAGE TO OR LOSS OF YOUR PROPERTY.

 

If you drive your own vehicle in the course of the Activities, you will maintain up-to-date vehicle insurance. You understand that as a volunteer driver, your personal vehicle insurance will be activated for any accidents or incidents that involve your vehicle, including those that occur while you are serving as a volunteer driver for Heart of Dinner. You also understand that Heart of Dinner will not be liable for any damages to your vehicle sustained while performing duties on their behalf.

5. Indemnification. You hereby agree to indemnify, defend, and hold harmless the Organization from any and all liability, losses, damages, judgments, or expenses, including attorneys' fees, that it may incur or sustain as a result of your negligence, recklessness, or willful misconduct in connection with your participation in the Activities, arising out of any third-party claim.

 

6. Photographic Release. You understand and agree that during the Activities, you may be photographed and/or videotaped by the Organization for internal and/or promotional use. You hereby grant and convey to Heart of Dinner all right, title, and interest, including but not limited to, any royalties, proceeds, or other benefits, in any and all such photographs or recordings, and consent to Heart of Dinner’s use of your name, image, likeness, and voice in perpetuity, in any medium or format, for any publicity without further compensation or permission.

 

7. Works Made for Hire. Heart of Dinner is and will be the sole and exclusive owner of all right, title, and interest in and to the results and proceeds of any works of art, works of authorship, photographs, videos, or other similar works including any materials created or developed by you pursuant to this Agreement (collectively, the "Works") including without limitation all copyrights, other intellectual property rights, and exploitation rights therein, in perpetuity, throughout the universe, in any and all media whether now or hereafter known or devised. You agree that the Works have been specially ordered or commissioned by Heart of Dinner for use as part of an audiovisual work, the Works are works made for hire for Heart of Dinner as defined in Section 101 of the Copyright Act of 1976, and Heart of Dinner is and shall be considered the sole and exclusive author of the Works. To the extent the Works or any part thereof do not qualify as work made for hire, you hereby irrevocably and unconditionally: (i) assign, transfer, and otherwise convey to Heart of Dinner throughout the universe, in perpetuity, in any and all media whether now or hereafter known or devised, and by any and all technologies and means of delivery whether now or hereafter known or devised, all right, title, and interest in and to such Works, including without limitation all copyrights and other intellectual property rights therein. Without limiting the foregoing, Heart of Dinner’s rights in the Works include the right to change, edit, and rearrange the Works, and subtract from, add to, and combine the Works with any other material, in whole or in part, as Company and its successors and assigns determine in their sole discretion.

This agreement is effective as of the date you participate in the Activities as a volunteer and will remain in full force and effect until you terminate your volunteer work with Heart of Dinner.

By participating in the Activities as a volunteer, you acknowledge that you have read and understand this agreement and agree to be bound by its terms and conditions.

COVID-19 SAFETY INFORMATION:

While participating in events held or sponsored by Heart of Dinner, consistent with CDC guidelines, participants are encouraged to abide by the preventative measures listed below to reduce the risks of exposure to COVID-19. Because COVID-19 is extremely contagious and is spread mainly from person-to-person contact, Heart of Dinner has put in place preventative measures to reduce the spread of COVID-19. However, Heart of Dinner cannot guarantee that its participants, volunteers, partners, or others in attendance will not become infected with COVID-19.

 

PREVENTATIVE MEASURES

For any and all Heart of Dinner related activity or operations, we ask that you please be mindful of your own safety, as well as the safety of our beloved Elderly recipients and fellow volunteers. To keep everyone as safe as possible so that we can continue to carry forth the mission of countering isolation and food insecurity within the Asian Elderly communities with basic necessities of nutritious comfort food and handwritten notes that lift the morale, please be sure to follow the below protocols: 

  • You must be fully vaccinated. 

  • In order to operate or participate in any Heart of Dinner activity, you must show proof of vaccination and ID or else you will not be allowed to operate or participate. 

  • Keep 6 feet distance apart from others whenever possible. 

  • Wear disposable gloves at ALL times when packing and delivering care packages.

  • Wash hands often with soap and water for at least 20 seconds.

  • Wear masks at ALL times (if you are not wearing a KN95 or N95 mask, please double mask.)

  • If possible, open windows and/or doors for ventilation and bring layers of winter clothing to stay warm.

  • Separate yourself at least 6 feet distance from others when removing your mask to eat or drink.

  • For additional preventative measures, refer to the CDC for the their up-to-date preventative guidelines by clicking here.

IF EXPOSED TO SOMEONE WHO TESTS POSITIVE WITH COVID-19 WHILE VOLUNTEERING WITH HEART OF DINNER: 

Refer to the CDC for the their up-to-date guidelines on next steps for those who may have been exposed while volunteering with or participating in Heart of Dinner activities. Click here for the full CDC guidelines.

 

For volunteers who are fully vaccinated, please read the below statement copied/pasted directly from the CDC guidelines: "Quarantine if you have been in close contact (within 6 feet of someone for a cumulative total of 15 minutes or more over a 24-hour period) with someone who has COVID-19, unless you have been fully vaccinated. People who are fully vaccinated do NOT need to quarantine after contact with someone who had COVID-19 unless they have symptoms. However, fully vaccinated people should get tested 5-7 days after their exposure, even if they don’t have symptoms and wear a mask indoors in public for 14 days following exposure or until their test result is negative."

In light of the ongoing spread of COVID-19, individuals who fall within any of the categories below should not engage in Heart of Dinner events and/or other face-to-face activities. By attending a Heart of Dinner event, you certify that you do not fall into any of the following categories:  

  1. Individuals who currently or within the past fourteen (14) days have experienced any symptoms associated with COVID-19, which include fever, cough, and shortness of breath among others;

  2. Individuals who have traveled at any point in the past fourteen (14) days either internationally or to a community in the U.S. that has experienced or is experiencing sustained community spread of COVID-19; or  

  3. Individuals who believe that they may have been exposed to a confirmed or suspected case of COVID-19 or have been diagnosed with COVID-19 and are not yet cleared as non-contagious by state or local public health authorities or the health care team responsible for their treatment.
